A INTELIGÊNCIA ARTIFICIAL E A PROTEÇÃO DA VONTADE DO ELEITOR:UMA ANÁLISE DO PODER NORMATIVO DO TSE NAS ELEIÇÕES 2026

A revolução digital alterou, de forma irreversível, a gramática da comunicação política. No tabuleiro eleitoral, o adventoda inteligência artificialnão apenas potencializou a difusão de ideias, mas trouxe consigo vetores de risco inéditos à integridade democrática. Hoje, a produção de conteúdos sintéticos,textos,sonsevídeosquemimetizamarealidadecomprecisãoassustadoracolocaemxequealivreformaçãodo convencimentodocidadão.Ciente desse abismo tecnológico, a Justiça Eleitoral brasileira viu-se compelida a calibrar sua atuação normativa. O Tribunal Superior Eleitoral (TSE), exercendo sua competência regulamentar, editou resoluções específicas para as eleições de 2026, buscandoimpor balizas éticas e técnicas ao uso da IA nas campanhas. O foco da Corte é claro: proibir a manipulação grosseira que induz ao erro, exigir o rótulo de "conteúdo assistido" e vetar o uso de sistemas automatizados que anulem a autonomia do eleitor.Este trabalho propõe um exame crítico sobre como esse poder normativo atua como escudo da vontade popular. Através de uma pesquisa qualitativa, que perpassa a doutrina e as recentes resoluções do TSE, investiga-se se as travas regulatórias são suficientes para garantir alegitimidade do pleito frente à sofisticação dos algoritmos. Conclui-se que a intervenção normativa da Justiça Eleitoral não é apenas desejável, mas um pressuposto de sobrevivência para a normalidade democrática em tempos de desinformação tecnológica.
