A PRISÃO APÓS CONDENAÇÃO CONFIRMADA PELA SEGUNDA INSTÂNCIA E A INTERPRETAÇÃO CONSTITUCIONAL FEITA PELO STF

O presente trabalho apresentará um estudo sobre a constitucionalidade da prisão em segunda instância após a condenação confirmada pelo Supremo Tribunal Federal (STF). Tem como objetivo a análise do cumprimento da pena antes do trânsito em julgado da decisão, tema que é alvo de intensa controvérsia na via jurisdicional. Adotou-se como parâmetro a atual interpretação do STF sobre a questão. Neste víeis, serão confrontados os argumentos apresentados pela hermenêutica aplicada frente os direitos fundamentais esculpidos na Constituição Federal de 1988. A finalidade do estudo é apresentar a relativização do princípio da presunção de inocência, sem ofender seu núcleo essencial como forma de tratamento do acusado. A metodologia aplicada é a revisão de doutrinas, jurisprudências e sites relacionados ao tema. Evidencia-se com o estudo deste a possibilidade de execução da reprimenda após confirmação pela segunda instância da condenação, proferida pelo juízo de primeiro grau.
