Resumen

O presente artigo científico visa analisar a Responsabilidade Civil do Estado frente a atos praticados por presos beneficiados com a saída temporária. Sob o ângulo da temática proposta, serão ponderados os elementos e os requisitos que compõem a saída temporária, bem como os elementos que constituem a Responsabilidade Civil. Nesse espectro, buscam-se as casualidades que permitem a responsabilização do Estado por crimes praticados por presos, que gozam do benefício da saída temporária. Serão expostas as falhas na vigilância dos presos durante esse período, bem como as formas de reparação de eventual dano ou prejuízo à sociedade advindo de tal situação, tendo como finalidade uma possível indenização. A metodologia utilizada na construção desse trabalho foi uma revisão de literatura consultando autores como. GRECO, (2011); FILHO, (2012); ESTEFAM, (2012); DINIZ, (2012) entre outros.
