ADOÇÃO INTUITU PERSONAE E A SUA ADMISSIBLIDADE LEGAL SOBRE O PRISMA DO MELHOR INTERESSE DO MENOR

A proposta da adoção intuito personae está ligada à possibilidade da mãe biológica indicar uma família substituta para entregar seu filho, o que torna desnecessário a estadia do menor em abrigos e diminui a quebra de vínculos, favorecendo seu desenvolvimento. Tal procedimento trata-se de uma nova alternativa para diminuir as longas filas de espera de menores para adoção, evitando-se que eles permaneçam esquecidos nos referidos abrigos públicos e proporcionando mais benefícios a eles, em razão de serem escolhidos de acordo com a vontade de seus pais biológicos, ou seja, mesmo não assumindo a responsabilidade da criação de seu filho em virtude de algum motivo especifico, presume-se que os pais biológicos ainda desejem seu melhor e tendem a escolher uma boa família para a criação da criança. Toda a proposta se baseia no princípio do melhor interesse do menor, consubstanciado no Estatuto da Criança e do Adolescente.
