ANÁLISE JURÍDICA DA INDEXAÇÃO DO SALÁRIO MÍNIMO NA FIXAÇÃO DA PENSÃO ALIMENTÍCIA A LUZ DA CONSTITUIÇÃO FEDERAL

A presente pesquisa apresenta uma visão geral do instituto alimentos, trazendo o seu fundamento constitucional e conceito, tendo como embasamento teórico o Código Civil Brasileiro de 2002 e a Constituição Federal Brasileira. Este trabalho versa, especificamente, sobre a análise jurídica da indexação do salário mínimo na fixação da pensão alimentícia a luz da Constituição Federal e seus reflexos sociais. Serão apresentados o ponto de vista daqueles que defendem e daqueles que não são favoráveis a essa prática, trazendo também o posicionamento adotado atualmente pelo Supremo Tribunal Federal. Por fim aborda-se os aspectos econômico-financeiras que envolvem o reajuste dos alimentos.
