SÍNDROME DE DOM CASMURRO NO PROCESSO PENAL BRASILEIRO

O presente trabalho buscar fazer uma breve síntese acerca do tema Síndrome de Dom Casmurro no Código Processual Penal Brasileiro (CPP), abordando pontos dos sistemas adotados por este, bem como fazendo um paralelo entre a história/narrativa do livro de Dom Casmurro com os sistemas acusatórios que há no CPP, explicando cada um destes; após, esclarecendo qual deles o Brasil adotou. Metodologicamente, o presente trabalho orienta-se por análise de fontes documentais, doutrinas, legislação vigente, artigos científicos, sendo estes tendentes a subsidiar esta pesquisa, bem como demonstrar o porquê esta síndrome não pode ocorrer no sistema processual pátrio. Assim, verifica-se que a síndrome supracitada deve ser expurgada do CPP, uma vez que esta macula a figura do juiz, infringindo direitos fundamentais do acusado, especificamente no que concerne ao princípio/direito da não culpabilidade ou não culpa, entre outros que serão trazidos à baila no decorrer do trabalho.
