DA (IN) COSTITUCIONALIDADE DA ALTERAÇÃO DO LIMITE MÁXIMO DE CUMPRIMENTO DE PENA DE 30 (TRINTA) PARA 40 (QUARENTA) ANOS CONFORME REDAÇÃO DA LEI 13.964 DE 2019.

A Lei 13.964 de 2019 alterou o artigo 75 do Código Penal, elevando o limite máximo de cumprimento das penas no Brasil de 30 para 40 anos. Por um lado, há aqueles que apoiam fundamentando na necessidade de rebuscar as leis penais para conter o exacerbado índice de criminalidade atual, por outro há os que discordam afirmando que a alteração desencadearia o aumento de tal índice, além de estar em dissonância com a vedação de penas em caráter perpétuo no país. Neste interim, esse trabalho se dedica ao estudo das consequências jurídicas que a nova redação do ora mencionado artigo gera no sistema penal, analisando se é aprovada pelo crivo de constitucionalidade exercido pela Constituição Federal; no sistema prisional, evidenciando a já caótica situação da superlotação carcerária sob a nova ótica dos efeitos dessa alteração; e como influirá diretamente no controle à crescente violência no país. Todas as considerações são fundadas pela análise doutrinária, legislativa e jurisprudências do ordenamento jurídico nacional.
