OS PROJETOS DE LEI Nº. 6.579/2013 E Nº. 583-A/2011 E OS DESAFIOS PARA A FINALIDADE RESSOCIALIZADORA DA PENA

O presente artigo investigou os projetos de lei 6.579/2013 e 583-A/2011, com o intuito de identificar quais os fundamentos utilizados pelos congressistas para propor referidos projetos de lei, que retiram de forma completa o direito de saída temporária dos presos. Ressalta-se que esse direito é assegurado como contraprestação pelo bom comportamento e também como forma de ressocialização, consagrada em nosso sistema de execução penal. Para tanto, adotou-se a pesquisa descritiva exploratória, por meio de análise da legislação pertinente, tendo como fontes primárias a Constituição da República Federativa do Brasil de 1988 e a Lei de Execução Penal, além dos projetos de lei. Conclui que os fundamentos utilizados versavam sobre os índices não oficiais de evasão dos presos que não retornam, além de externamente ser identificado o conservadorismo como fator aglutinador.
