ANÁLISE SOBRE O GARANTISMO PENAL E A CRIMINALIDADE NO BRASIL

Este artigo analisa as causas subjacentes do aumento da criminalidade no Brasil, explorando fatores econômicos, sociais e políticos que contribuem para esse fenômeno. Por meio de levantamento bibliográfico e jurídico-documental, aborda questões de desigualdade social, acesso à educação, eficácia das políticas de segurança pública, garantismo penal excessivo, disparidade sistemática entre diferentes grupos étnico-raciais em termos de acesso a recursos e desafios estruturais enraizados na sociedade. Reflete sobre o contexto criminal brasileiro ao contrapor o garantismo penal e o determinismo social como fatores para o aumento da criminalidade no Brasil. Conclui ser de suma importância a responsabilização criminal e a não vitimização ou romantização do crime, como forma de proteção social, gerando o bem-estar, finalidade estatal.
