JUDICIALIZATION OF RURAL CREDIT: AN ANALYSIS OF THE EVOLUTION OF DEBT EXTENSION PROCESSES IN A FAMILY FARMING REGION IN SOUTHERN BRAZIL

This study analyzes the judicialization of rural credit through the evolution of lawsuits related to debt rescheduling in a family farming region in Southern Brazil. The objective was to understand how growing litigation involving rural credit reflects transformations in the relationship between agricultural finance, economic vulnerability and institutional mechanisms for debt management. Methodologically, the research is descriptive-exploratory, with a quantitative approach, based on secondary data extracted from court cases processed in the judicial district of Marechal Cândido Rondon, Paraná, between 2010 and 2025. A total of 285 cases related to debt rescheduling, contractual renegotiation and rural credit executions were identified. The results show an increase in judicialization over the historical series, with recent intensification of lawsuits, cyclical patterns of litigation and qualitative changes in the profile of disputes, particularly through the growth of revision claims and increasing complexity of procedural outcomes. Findings also suggest recurrent indebtedness and cumulative vulnerability among rural families, indicating that judicialization goes beyond a strictly contractual dimension and is associated with structural weaknesses in agricultural financing. Furthermore, the results indicate that the effects of this phenomenon may extend to regional development, particularly in territories strongly dependent on family farming. It is concluded that the judicialization of rural credit emerges not only as a response to financial conflicts, but also as an indicator of institutional, economic and territorial tensions affecting the sustainability of rural credit and agricultural production. The study contributes to advancing debates on rural credit, risk management and regional development by providing empirical evidence on a phenomenon still underexplored in the literature.
