INTELLECTUAL PROPERTY RIGHTS INFRINGEMENTS AND THE MULTI-DOOR COURTHOUSE SYSTEM

Several violations of intellectual property rights give rise to legal consequences in both the civil and criminal spheres. However, is state jurisdiction the best avenue for resolving a specific dispute when dealing with civil conflicts involving disposable rights, particularly those related to contractual relationships, academic collaboration, the economic exploitation of intangible assets, or the preservation of relationships between the parties? In addition to the delays inherent in judicial proceedings, it is also necessary to consider the strain placed on the relationship between those involved. In the context of intellectual property, delays in resolving disputes may result in irreparable financial losses or, where the parties are collaborators, may jeopardize the continuity of the partnerships that are essential to the success of intellectual production. This article aims to analyze the Multi-Door Courthouse System as a safer alternative for addressing civil violations involving disposable rights. The research adopted a qualitative approach, with an exploratory and descriptive character, employing bibliographic and documentary methods based on the analysis of legal scholarship, case law, and statutory provisions.The results indicate that, although the Multi-Door Courthouse System encompasses state jurisdiction, it also provides several pathways for dispute resolution. It is concluded that adopting a comprehensive view of this system may be the most appropriate means of resolving disputes in a faster and more efficient manner, provided that due consideration is given to the nature of the violated right, the urgency of the protection sought, the availability of the legal interest at stake, the parties’ prior relationship, and the need for confidentiality. Such an approach grants the parties greater autonomy and a more active role in decision-making, enabling them to participate directly in the resolution process and thereby increasing the likelihood of preserving their relationships.
