A (IN)EFICIÊNCIA DA HOLDING FAMILIAR COMO PLANEJAMENTO SUCESSÓRIO

This article deals with cases in which it is useful to set up a family holding company as succession planning, which uses asset shielding as a way of protecting assets. It is a relatively new institute in Brazilian law, which is currently being widely sold by lawyers and accountants as a tax and bureaucratic solution for succession. The objective of the research, therefore, is, through bibliographical research, and the deductive method, to determine whether the constitution of a family holding company is effective for the realization of succession planning, that is, if it accelerates the transfer of assets and reduces the tax burden of this, as well as in which cases its constitution is appropriate.
