A (IN)EFICIÊNCIA DA HOLDING FAMILIAR COMO PLANEJAMENTO SUCESSÓRIO

O presente artigo trata dos casos em que é útil constituir uma holding familiar como planejamento sucessório, a qual usa da blindagem patrimonial como forma de proteção do patrimônio. É um instituto relativamente novo no direito brasileiro, que atualmente vem sendo muito vendido por advogados e contadores como uma solução tributária e burocrática para a sucessão. O objetivo da pesquisa, portanto, é, por meio da pesquisa bibliográfica, e do método dedutivo, apurar se a constituição de uma holding familiar é efetiva para concretização do planejamento sucessório, ou seja, se acelera a transferência do patrimônio e reduz a carga tributária desse, bem como em quais casos é adequada a sua constituição.
