Abstract

O presente artigo tem como objetivo discutir acerca da Alienação Parental e seus meios probatórios no âmbito do processo judicial. Com abordagem sobre o Direito de Família em que o tema apresenta suas raízes, sendo conceituado de forma objetiva conforme a legislação e a doutrina majoritária. Será realizada a análise dos sujeitos que participam da prática bem como as características que rodeiam as atitudes dos genitores alienantes. Versando sobre a funcionalidades das provas no ambiente processual e quais provas a legislação que trata sobre o tema apresenta. Aborda quais medidas poderão serem adotadas pelo magistrado diante de casos confirmados de alienação parental e como será feita a disposição da guarda entre os genitores, conforme interesses do menor e da legislação vigente.
