THE INFLUENCE OF LAY JURORS ON JURY COURT DECISIONS: IMPLICATIONS FOR IMPARTIALITY AND CRIMINAL JUSTICE

Este estudo aborda a dinâmica do Tribunal do Júri no Brasil, investigando sua base constitucional e o impacto da participação de jurados leigos no julgamento de crimes dolorosos contra a vida. Com base na Constituição Federal de 1988, que atribuiu ao júri a competência para tais crimes, a pesquisa analisa a composição e o papel do Conselho de Sentença, formado por cidadãos, em contraste com a conduta técnica do juiz togado. O artigo explora a natureza democrática do Tribunal do Júri, que legitima a participação popular na justiça criminal, ao mesmo tempo em que levanta questões sobre as limitações decorrentes da falta de conhecimento técnico. A análise discute como esses cidadãos podem ser influenciados pela mídia e por fatores emocionais ou sociais que afetam a comunidade, comprometendo a imparcialidade que ocorre no processo criminal. A pesquisa também investiga a capacidade dos jurados leigos de lidar com casos complexos, ponderando se essa estrutura pode resultar em decisões equivocadas ou injustas. Nesse sentido, o estudo aprofunda-se no funcionamento e nas garantias processuais essenciais, como a ampla defesa e o sigilo do voto, avaliando o equilíbrio entre participação popular e efetividade jurídica, compreendendo os efeitos e desafios inerentes à inclusão do cidadão no sistema de justiça criminal.
