DA IMPUTABILIDADE DO PSICOPATA

Este trabalho discorre sobre um tema polêmico, apresentando o indivíduo com psicopatia, dentro da interpretação do Código Penal Brasileiro. Conceituar-se-á as características dos psicopatas, considerando as suas particularidades e distinções aos demais indivíduos, comentando em seguida sobre a aplicação da imputabilidade aos mesmos. Quanto ao método utilizado, efetuou-se pesquisa bibliográfica demarcando o caráter valorativo, possuindo estrutura descritiva mediante o propósito, recapitulando divulgações sobre o conteúdo, no período de 2002 a 2014. A psicopatia ainda é alvo de uma extensa demanda de estudos, mas com alguns pontos em comum partilhados por uma boa parte dos seus estudiosos. Implica-se a compreensão dos termos de inimputabilidade, semi-imputabilidade e imputabilidade de acordo com as Leis Penais. Concluiu-se que os psicopatas são imputáveis, mediante o caráter do seu comportamento não afetar a razão, não se tratando assim de uma doença mental, mas uma forma de ser no mundo.
