The termination of parental rights, especially in cases of child sexual abuse, constitutes an extreme legal measure, yet one that is indispensable to the realization of the principle of comprehensive protection. This article aims to analyze the legal grounds that justify state intervention in severing family ties when such ties become a means of violating the fundamental rights of children and adolescents. This qualitative study, based on a literature review and legislative analysis, examines the role of the Rights Guarantee System, with a focus on the roles of the Guardianship Council, the Public Prosecutor’s Office, and the Judiciary. Furthermore, it discusses parental neglect as a defining factor in the loss of parental rights and adoption as a mechanism for restoring the dignity of children and adolescents. It is concluded that the termination of parental authority, in these cases, is not merely punitive in nature, but represents an instrument for the protection and safeguarding of fundamental rights, with adoption being an essential step toward ensuring family life in a safe and dignified environment.
