ESTUPRO DE VULNERÁVEL:
UMA VISÃO ACERCA DA POSSIBILIDADE DE EXCLUSÃO DE ILICUTUDE A PARTIR DO CONSENTIMENTO DA VÍTIMA

Com o intuito de verificar as hipóteses sobre a exclusão de ilicitude no crime de estupro, e, então, refletir sobre a vulnerabilidade do adolescente (maior de 12 anos e menor de 14 anos de idade), o presente trabalho busca, através de uma revisão literária, explanar os efeitos do consentimento da vítima para, assim, estabelecer uma compreensão da problemática. A aplicabilidade deste estudo se dá devido a expressiva possibilidade de aplicação da justiça material através de uma causa supralegal.
