UM ESTUDO SOBRE A HISTÓRIA DA LEI DO FEMINICÍDIO

O presente estudo teve como objetivo dissertar sobre a história do crime de feminicídio, suas causas, formas, qualificadoras, hipóteses e conceitos. A metodologia utilizada foi uma pesquisa qualitativa por meio de revisão bibliográfica buscando explicar, explorar e compreender de forma imparcial a lei 13.104/2015. Para analisar as causas do feminicídio foram estudadas algumas obras científicas que tratam do assunto de alguns juristas brasileiros. O Feminicídio é um crime ao qual está presente desde os primórdios da sociedade e com o passar dos anos veio ganhado destaque no ordenamento jurídico. Pode-se afirmar que um grande marco nessa história foi o caso Maria da Penha que trouxe relevância para o assunto ao qual o sistema jurídico brasileiro não estava preparado para lidar na época. Concluiu-se que o feminicídio é um fenômeno que atinge todas as nações, tornando-se um problema de ordem global que acaba gerando um ambiente de indiferença na nossa sociedade. Criminalizar o feminicídio é relevante para nomear o problema, promover o debate acerca dele e fomentar a busca por formas eficazes de combater a violência de gênero em todos os âmbitos e em todas as suas formas, inclusive evitando o seu ápice que é o homicídio da vítima.
