LAS COOKIES Y LA (IN)VIOLABILIDAD DE LOS DERECHOS DE LA PERSONALIDAD

No cabe duda que el tema de internet es sumamente actual en el contexto en el que vivimos, ya que, a través de Internet, es posible realizar compras, ver películas y series, tener acceso a cuentas bancarias, entre otras infinitas posibilidades de navegación creadas para hacer la vida más fácil para las personas. Sucede que los usuarios se enfrentan al mensaje de aceptar o rechazar cookies en la mayoría de los sitios y, a menudo, es obligatorio aceptar dicha política de uso. Así, este artículo tiene como objetivo analizar el funcionamiento del uso de cookies por parte de los sitios web. El objetivo de este artículo es explicar qué son estos ficheros, su funcionalidad y cómo se utilizan en los sitios web, además de analizar si las cookies pueden recopilar datos sensibles de los usuarios, de modo que esto pueda afectar a los derechos de la personalidad. Como objetos para la construcción de este artículo se utilizarán libros y artículos ya publicados sobre el tema. Además, esta investigación también tiene como objetivo explicar el funcionamiento de la política de uso de cookies por parte de los sitios web protegidos por el Marco de los Derechos Civiles en Internet (Ley nº 12.965/2014) y la Ley General de Protección de Datos (Ley nº 13.709/2018), con la finalidad de verificar qué datos se recogen mediante las cookies de los sitios web, además de analizar si dichos datos recogidos son personales y sensibles de forma que puedan afectar o no a los derechos de personalidad de los usuarios.
