INDENIZAÇÃO POR NEGATIVAÇÃO INDEVIDA

O presente artigo tem como objetivo relatar um tema bastante comum em meio a sociedade, afetando diretamente o direito do consumidor, no qual grande parte da população passa ou já passou pelo fato narrado a seguir, seja ela na forma de pessoa física ou jurídica, no qual ao ser consultado determinadas informações pessoais para adquirir créditos consignados ou aquisição de bens em forma de financiamento, tem o conhecimento de que o cadastro se encontra indevidamente negativado, causando transtorno e gerando incomodo entre as partes que ali se encontra. Vale salientar que nesse caso, cabe indenização em favor da pessoa física ou jurídica lesada por empresas, que são responsáveis por atos de negativação.
