A CONVERGÊNCIA DAS MEMÓRIAS E A PRODUÇÃO DE PROVAS TESTEMUNHAIS

O artigo discute a influência das falsas memórias no processo penal brasileiro, particularmente no âmbito do Tribunal do Júri. O foco principal é analisar como a memória humana, fundamental para a prova testemunhal, é suscetível a distorções e falhas, especialmente com o passar do tempo, comprometendo a confiabilidade das informações e aumentando o risco de condenações injustas. O estudo explora diferentes tipos de falsas memórias e seus impactos, além de propor medidas para mitigar os riscos de erros e distorções nos depoimentos testemunhais, como a utilização de protocolos de entrevista baseados em pesquisas científicas e a antecipação da prova testemunhal.
