O artigo analisa os desafios jurídicos da responsabilidade civil das plataformas de redes sociais pela veiculação de conteúdo ilícito e fake news no Brasil. A pesquisa examina o Marco Civil da Internet (Lei n° 12.965/2014) e o polêmico Artigo 19, que condicionava a remoção de conteúdo ilícito à ordem judicial específica.
O ponto central do estudo é a decisão do Supremo Tribunal Federal (STF), proferida em junho de 2025, que declarou a inconstitucionalidade parcial do Artigo 19.
