LA MATERNIDAD EN PRISIÓN: DERECHOS Y DESAFÍOS DE LAS RECLUSAS EMBARAZADAS EN BRASIL.

La maternidad en prisión es un tema que suscita profundas reflexiones sobre los derechos humanos, el sistema penitenciario y las políticas públicas en Brasil. Esta revisión bibliográfica analiza los principales desafíos que enfrentan las mujeres embarazadas privadas de libertad, así como los derechos garantizados por la legislación nacional e internacional. La investigación muestra que las reclusas embarazadas frecuentemente sufren violaciones de derechos fundamentales, como el acceso inadecuado a servicios de salud, la falta de atención prenatal de calidad, las condiciones insalubres de encarcelamiento y la separación temprana de sus bebés tras el parto. A pesar de la existencia de normativas como la Ley N° 13.769/2018, que permite la sustitución de la prisión preventiva por arresto domiciliario para mujeres embarazadas y madres de niños pequeños, la aplicación de estas medidas aún enfrenta resistencia y desigualdad. La revisión también señala la escasez de políticas públicas efectivas y la invisibilidad social de estas mujeres, quienes terminan sufriendo doble castigo: por el delito cometido y por la maternidad vivida bajo vigilancia. Se concluye que es esencial ampliar el debate público, sensibilizar a los agentes del sistema penitenciario e implementar eficazmente medidas que garanticen la dignidad, la salud y el bienestar de las madres y los niños en el contexto carcelario.
