VIOLENCIA INTRAFAMILIAR: UN ANÁLISIS JURÍDICO Y SOCIAL DE LA VIOLACIÓN DE PERSONAS VULNERABLES DURANTE LA PANDEMIA DE COVID-19

Este artículo analiza la violencia doméstica en Brasil, entre 2020 y 2023, centrándose en el delito de violación de personas vulnerables durante la pandemia de COVID-19. La investigación adopta un enfoque cualitativo-cuantitativo, mediante la revisión de la literatura y el análisis documental, basados en la doctrina jurídica, artículos científicos, jurisprudencia y legislación pertinente. El estudio se estructuró en torno a tres ejes: fundamentos jurídico-conceptuales de la violencia doméstica y la violación de personas vulnerables; análisis de la incidencia de este delito durante la pandemia; y examen estadístico de las denuncias registradas. Los resultados indican una alta incidencia de violencia sexual contra niños, niñas y adolescentes, con 44.987 casos entre 2020 y 2021, lo que corresponde al 74% de las incidencias. Se observó una mayor concentración entre las víctimas femeninas del grupo de edad de 10 a 14 años (37,26%), mientras que, entre los varones, destacó el grupo de edad de 5 a 9 años (5,15%). El hogar fue el lugar principal donde se produjo el abuso (72%), y los perpetradores fueron en su mayoría familiares cercanos (30%) y conocidos (25%). También se encontró que el 44% de los casos involucraron violencia reiterada. En conclusión, el entorno familiar puede ser un espacio de vulnerabilidad, lo que refuerza la necesidad de políticas públicas dirigidas a proteger a la infancia y la adolescencia. Este estudio contribuye al avance del debate jurídico y social sobre la violencia sexual doméstica al destacar los factores estructurales asociados a su ocurrencia y al apoyar la formulación de estrategias de prevención y afrontamiento más eficaces.
