INCLUSÃO ESCOLAR NO BRASIL: ASPECTOS CONSTITUCIONAIS, LEGAIS E EDUCACIONAIS

O presente artigo tem como objetivo geral analisar a evolução histórica e legal da educação inclusiva no Brasil, identificando barreiras e desafios para sua efetivação. Para isso, a metodologia adotada foi a pesquisa bibliográfica e documental, com análise de legislações, normas internacionais e estudos acadêmicos sobre inclusão educacional. A pesquisa evidenciou que, embora a legislação brasileira, incluindo a Constituição de 1988, a LDB (1996) e a Lei Brasileira de Inclusão (2015), estabeleça princípios de igualdade, dignidade e não discriminação para pessoas com deficiência, sua efetividade depende da implementação prática, da formação docente, da infraestrutura adequada e da mudança cultural. Barreiras físicas, tecnológicas, atitudinais e institucionais ainda limitam a inclusão plena, revelando que o acesso à educação inclusiva exige políticas estruturais, fiscalização, responsabilização e participação social. A inclusão é, portanto, um processo político, ético e coletivo que demanda ação coordenada para transformar direitos formais em prática concreta.
