CUSTODY HEARING AND THE CONTROL OF THE LEGALITY OF DETENTION: EFFECTIVENESS, LIMITS, AND THE ROLE OF LEGAL COUNSEL IN THE BRAZILIAN CRIMINAL PROCESS

The custody hearing has become a central instrument for controlling the legality of detention in the Brazilian criminal process. This study aims to analyze its effectiveness in light of theoretical frameworks related to the exceptional nature of pretrial detention, the requirement for judicial justification, the role of the defense counsel, the protection of human rights, and selective prosecution. The investigation adopts a predominantly qualitative approach, based on the analysis of judicial decisions and institutional elements of the criminal justice system, articulated with the applicable normative and doctrinal framework. The results indicate the existence of tensions between the constitutional model of guarantees and its practical implementation, especially regarding the justification of decisions, the role of the defense, and the institutional conditions of the system's functioning. It is also observed that the effectiveness of the custody hearing is related to structural and procedural factors that influence the decision-making dynamics. It is concluded that, although it represents a relevant normative advance, the custody hearing still faces challenges to establish itself as a fully effective mechanism for controlling the legality of imprisonment, requiring the improvement of jurisdictional practices, the strengthening of technical defense, and the adaptation of institutional structures.
