Abstract

This article examines the mandatory periodic review of preventive detention introduced by the sole paragraph of Article 316 of the Brazilian Code of Criminal Procedure, as amended by Law No. 13,964/2019 (Anti-Crime Package). The main objective is to analyze the legal nature of the duty to reassess preventive detention every 90 days and to investigate the legal consequences arising from non-compliance, particularly considering the controversy surrounding the possibility of automatic release of the defendant. The study adopts a qualitative methodology, grounded in a legal-dogmatic approach, based on a review of specialized legal literature and an analysis of precedents from the Federal Supreme Court and the Superior Court of Justice. It is hypothesized that the provision aims to reinforce the exceptional nature of preventive detention and to enhance judicial control over its duration, preventing its use as a form of anticipatory punishment. The findings indicate that, although the legal text provides that failure to review renders the detention unlawful, the prevailing interpretation of higher courts rejects automatic release, requiring a reasoned judicial decision. It is concluded that the effectiveness of the rule depends on its rigorous enforcement, balancing individual liberties with legal certainty and public order.
