THE EFFECTIVENESS OF MORAL DAMAGES COMPENSATION IN VIRTUAL IMAGE ATTACKS: A REVIEW OF CONTEMPORARY LEGAL LITERATURE

This study analyzes the effectiveness of moral damage compensation in cases of virtual attacks on personal image, considering the transformations resulting from the intensification of digital interactions and their impacts on the protection of personality rights. The research aims to understand the limits and potentialities of civil liability in the virtual environment, especially regarding its compensatory, pedagogical and preventive functions. To this end, a qualitative, exploratory and descriptive approach was adopted, developed through a literature review based on recent scientific productions. The results indicate that, although compensation is widely used as a reparation mechanism, its effectiveness is limited due to the diffuse, continuous and highly disseminated nature of digital harm. It is also observed the need to improve the criteria for quantifying moral damages, as well as to strengthen preventive and regulatory measures. It is concluded that civil liability, to be effective in this context, must go beyond a merely compensatory logic, incorporating integrated strategies that consider the complexity of digital relations.
